This groundbreaking regulation, which constitutes the world's first comprehensive legal framework specifically addressing AI, came into force in August 2024. With this pivotal moment, corporate leaders and organisations can no longer afford to treat AI governance as a distant concern or a problem reserved for the future. The urgency is palpable, as prohibited practices have been strictly banned since February 2025, and obligations concerning General-Purpose AI are now enforceable, necessitating immediate and proactive action from businesses across all sectors.


The regulation employs a sophisticated four-tier risk framework that intricately determines the compliance obligations that organisations must adhere to based on the risk level associated with their AI systems. At the top of this hierarchy, prohibited AI systems - which include controversial social scoring mechanisms and tools designed for subliminal manipulation - are banned outright. These prohibitions reflect a commitment to ethical standards and societal values, ensuring that harmful technologies are kept at bay. Following this, high-risk AI systems, which encompass critical areas such as infrastructure, employment decisions, access to education, and law enforcement, are subject to the most stringent compliance requirements. Organisations deploying these systems must conduct mandatory conformity assessments, maintain comprehensive documentation, and engage in continuous monitoring to ensure adherence to the established guidelines. Limited-risk systems, such as chatbots, are required to meet specific transparency obligations, whilst minimal-risk applications remain largely unregulated, highlighting a tiered approach to governance that aims to balance innovation with safety.


The financial repercussions for failing to comply with these regulations are severe and have been intentionally structured to capture the attention of C-suite executives and board members. Organisations found to be deploying prohibited AI systems could face staggering penalties of up to €35 million or 7% of their global annual turnover, whichever amount is greater. For violations associated with high-risk systems, the penalties can reach €15 million or 3% of worldwide turnover, whilst even minor documentation failures can incur costs of €7.5 million or 1% of turnover. It is critical to note that these penalties are not confined to entities operating solely within the EU; any AI system that reaches users in the EU is subject to the jurisdiction of the Act, regardless of where the system is deployed, which amplifies the global implications of this regulation.


"No Grace Period, No Pause"


The European Commission's Guidance Package, released in July 2025, has provided essential implementation support just days before the enforcement deadline for General-Purpose AI. This guidance includes a General-Purpose AI Code of Practice and mandatory disclosure templates, which are designed to assist organisations in navigating the complex compliance landscape. Despite significant pressure from various industry stakeholders advocating for delays in implementation, the Commission has made it clear that there will be no grace period or pause in enforcement, emphasising the urgency of compliance.


However, the enforcement of the Act is expected to be somewhat convoluted. The European AI Office will oversee General-Purpose AI models and coordinate cross-border enforcement efforts, whilst national authorities will manage other AI systems, with their full enforcement powers commencing in August 2026. This dual-layered enforcement structure introduces additional risks for companies, as historical precedents indicate that some national enforcement actions may be biased in favour of local enterprises over foreign competitors, potentially leading to an uneven playing field in the market.


The key takeaway is unequivocal: with such extreme penalties looming on the horizon, traditional technology governance frameworks are fundamentally insufficient for ensuring compliance in the realm of AI. Organisations must fundamentally rethink and transform their approach to developing, procuring, deploying, and monitoring AI systems throughout the entire operational lifecycle. This transformation will require a concerted effort to integrate compliance into the core business strategy and operations, ensuring that AI governance is not merely an afterthought but a central element of corporate responsibility and risk management.


Corporate Obligations for Compliance


Understanding your role under the EU AI Act is crucial for any organisation involved in the deployment of artificial intelligence technologies. The definitions outlined in the Act are not merely legal jargon; they carry significant implications for how businesses operate. The term "Deployers" refers to any entity that utilises AI systems in a professional capacity, which explicitly excludes personal or casual use. However, organisations must tread carefully: if you substantially modify an AI system, change its intended purpose to something classified as high-risk, or even rebrand the system, you transition into the category of "Providers." This shift brings with it a host of stricter obligations that are designed to ensure compliance with the rigorous standards set forth by the Act. It is a common misconception that compliance responsibilities can be outsourced to AI vendors. The Act makes it abundantly clear that the ultimate responsibility for compliance rests with you, the deployer, and cannot be transferred to third parties.


When it comes to High-risk AI systems, the Act imposes a series of comprehensive technical and organisational measures that must be meticulously adhered to. First and foremost, there is a critical requirement for robust human oversight. This means that organisations must employ qualified personnel who not only have the necessary training but also possess the authority to monitor AI operations and intervene when necessary. This oversight is essential to prevent potential harms and ensure that the AI systems operate within their intended parameters. Furthermore, data governance is a key component of compliance; organisations must ensure that all input data is thoroughly documented, remains relevant throughout the operational lifecycle, and is free from errors. This ongoing vigilance is crucial for maintaining the integrity of AI systems. Continuous monitoring protocols must be established to track the performance of these systems against their intended purposes. In the event that serious risks emerge, organisations are mandated to immediately suspend use of the AI system and report any incidents to the relevant authorities within strict timeframes, ensuring that accountability is maintained.


In addition to these operational requirements, the Act introduces stringent documentation and transparency obligations that add further layers of compliance complexity. Organisations are required to maintain automatically generated logs for a minimum of six months, although this duration may extend based on the specific purpose and function of the AI system in question. When deploying Workplace AI, employers are mandated to inform affected workers prior to implementation, following established EU consultation procedures. This requirement is designed to protect employees' rights and ensure they are aware of the technologies that may impact their work environment. Furthermore, public authorities and private entities that provide public services face additional obligations. They are required to conduct fundamental rights impact assessments, which involve documenting potential adverse effects that AI systems may have on individuals and society, as well as outlining mitigation measures to address these risks.


For Limited-risk AI systems, the Act stipulates clear disclosure requirements that must be adhered to when individuals interact with AI technologies. This includes the necessity for AI-generated content to be properly labelled, ensuring that users are aware of the nature of the information they are receiving. Additionally, users must be informed when AI systems engage in emotion recognition or biometric categorisation, which raises important ethical considerations regarding privacy and consent.


Crucially, all organisations must implement AI literacy programmes to ensure that their staff possess sufficient knowledge and understanding to make informed decisions regarding the use of AI systems and the associated risks. This requirement, which becomes effective in February 2025, extends beyond just technical teams; it encompasses all personnel involved in AI operations, highlighting the importance of a culture of awareness and responsibility throughout the organisation.


Your obligations do not stop at the organisational level; they extend across the entire AI supply chain. It is imperative that you verify that your AI providers have fulfilled their registration obligations and that the systems in use bear the appropriate CE markings, which indicate compliance with EU safety and performance standards. Additionally, it is essential to establish clear contractual allocations of compliance responsibilities with your vendors. Due diligence is a critical component of this process; it involves reviewing provider documentation, understanding the limitations of the AI systems being utilised, and maintaining comprehensive vendor management processes to ensure ongoing compliance and oversight.


The bottom line is clear: compliance responsibilities are not something that can be delegated or ignored. Organisations must take ownership of, manage, and demonstrate their AI governance across the complete operational lifecycle. This proactive approach not only ensures compliance with the EU AI Act but also fosters trust amongst stakeholders, enhances operational integrity, and promotes responsible AI usage in an increasingly complex technological landscape.


Building Resilient Governance Frameworks for Ethical AI Deployment


In today's rapidly evolving technological landscape, the establishment of robust AI governance is not just a necessity but an existential imperative for leading organisations across various sectors. The complexity and potential impact of artificial intelligence systems necessitate the implementation of multi-layered governance frameworks that seamlessly integrate strategic oversight, tactical management, and operational execution. At the strategic level, successful implementations are characterised by the formation of dedicated board-level AI oversight committees that ensure that AI initiatives align with the organisation's overall mission and values. Establishing regular governance committee sessions on a monthly basis, conducting quarterly risk assessment reviews, and organising annual strategy updates are vital practices that foster communication and cooperation amongst different departments. Additionally, investing heavily in cross-training initiatives is crucial; technical teams should be educated on legal requirements and compliance issues, whilst legal professionals must gain a foundational understanding of AI technologies. Business teams should also be equipped with knowledge about the implications of risks associated with AI systems to enable informed decision-making.


The implementation of a robust AI governance framework requires immediate and decisive action across three distinct phases: Foundation, Implementation, and Optimisation. During the Foundation phase, organisations should focus on establishing governance committees, conducting comprehensive inventories of existing AI systems, and performing initial risk assessments to identify potential vulnerabilities. The Implementation phase involves deploying effective monitoring systems, establishing vendor management protocols, and completing documentation frameworks that provide clarity and structure to AI governance efforts. Finally, the Optimisation phase is where organisations refine their processes, implement advanced analytics to enhance decision-making, and prepare for regulatory audits to ensure compliance with evolving standards.


Ultimately, the success of AI governance hinges on the recognition that it should be embraced as a strategic differentiator rather than merely a compliance obligation.
